UAE labour law resignation ticket eligibility

Under Article 13 of the UAE Labour Law, repatriation tickets are granted only upon termination. If you resign, switch jobs, stay in the UAE, or are dismissed for misconduct, you are not eligible.

As per the law, an employer must bear the cost of an employee’s repatriation under specific conditions. These include:

    1. Termination of the employment contract by the employer.
    2. The employee’s desire to return to their home country post-termination.

It is important to note that issuing a repatriation ticket is subject to an agreement between the employer and the employee, either through the employment contract or via a legal claim in case the employer refuses to provide it.

Despite being a statutory right, not all situations warrant a repatriation ticket. Some circumstances where an employee may not be eligible include:

    1. Switching to another employer within the UAE.
    2. Voluntary resignation from the current employment.
    3. Intention to stay within the UAE post-termination.
    4. Termination due to misconduct or reasons attributed to the employee.

“You are not eligible for a repatriation ticket if you are joining another employer, you resign from employment, you intend to stay in the UAE, or are terminated for misconduct or any other reason attributed to you,” according to Al Mulla, Labour Lawyer & Legal Consultant.
