    DMCC Labour Law Overview

The Dubai Multi Commodities Centre (DMCC) operates under the UAE Federal Labour Law, complemented by its Free Zone Rules and Regulations.

Significant updates have been introduced to align DMCC’s regulations with the evolving labor landscape of the UAE.

These updates address various aspects of employment, including contract stipulations, working hours, leave entitlements, and termination procedures.

Understanding these regulations is crucial for businesses operating within the DMCC Free Zone to maintain compliance and foster positive employer-employee relationships.

Below is an overview of key aspects of DMCC labor regulations as of 2024.

    DMCC’s Employment Contracts

In the DMCC, all employees must have a written employment contract that clearly outlines the terms and conditions of employment. These contracts should specify job responsibilities, compensation, working hours, and other pertinent details.

Employers are required to use DMCC’s mandatory contract templates to ensure consistency and compliance with the UAE Labour Law.

It’s important to note that all employment contracts entered into on or after 2 February 2022 are for a limited term, with the possibility of extension or renewal upon mutual agreement.

    Working Hours in DMCC

The standard working hours in the DMCC are eight hours per day, totaling 48 hours per week over a six-day workweek.

For companies operating a five-day workweek, the total working hours should not exceed 40 hours per week.

During the holy month of Ramadan, working hours are reduced by two hours daily. Employers must adhere to these regulations to ensure compliance with labor laws and to promote employee well-being.

    Leave entitlements Types

Employees in the DMCC are entitled to various types of leave:

    • Annual Leave: Employees are entitled to 30 calendar days after completing one year of service. Employees who have completed six months but not a full year are entitled to two days of leave each month.
    • Sick Leave: Employees are entitled to sick leave not exceeding 90 days per year, which can be continuous or intermittent. The sick leave is paid as follows: the first 15 days with full pay, the next 30 days with half pay, and any subsequent period without pay.
      DMCC
    • Maternity Leave: Female employees are entitled to maternity leave of 45 days with full pay if they have completed at least one year of continuous service. If they have not completed one year, they are entitled to the same period with half pay.
    • Public Holidays: Employees are entitled to official leave with full pay on public holidays as declared by the UAE government.

Termination and End of Service Benefits

Termination of employment in the DMCC must comply with the UAE Labour Law:

Both employers and employees can terminate the employment contract by providing a notice period as stipulated in the contract, which must be between 30 to 90 days.

Termination without notice is permissible only under specific circumstances outlined in the UAE Labour Law.

Employees are entitled to end-of-service benefits (EOSB) based on their length of service. The calculation follows: 21 days’ basic pay for each year of the first five years and 30 days’ basic pay for each additional year beyond five years.

It’s important to note that the total gratuity should not exceed two years’ total pay.

Understanding these aspects of DMCC labor law is crucial for ensuring legal compliance and fostering a fair working environment.

Employers and employees are encouraged to familiarize themselves with these regulations and seek legal advice when necessary to navigate the complexities of labor relations within the DMCC Free Zone.
